Gift Voucher Regulations
TERMS AND CONDITIONS FOR PURCHASING GIFT VOUCHERS
§1.
General provisions
- These regulations (hereinafter referred to as the " Regulations ") define the terms and conditions of using the "TRZPIOTKA" online store and purchasing Gift Vouchers to be used for the purchase of Goods on the Seller's website at https://trzpiotka.com/ (hereinafter referred to as the " Store ").
- The Regulations are the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (hereinafter referred to as the " Act on the provision of services by electronic means ").
- The Store is owned by Paulina Bohdanowicz, running a business under the name: TRZPIOTKA PAULINA BOHDANOWICZ (address of permanent place of business: ul. Górna 18, 05-805 Kanie), entered into the Central Register of Information on Business Activity kept by the minister responsible for economy, Tax Identification Number (NIP): 5342382533, National Business Registry Number (REGON): 368117406 (hereinafter referred to as the “ Seller ”).

- As part of its business activity, the Seller sells Gift Vouchers to be used for the purchase of Goods in the Seller's Store, which may be purchased by Buyers;
- In accordance with the provisions of Regulation (EU) 2022/2065 of the European Parliament and of the Council of
On October 19, 2022, on the single market for digital services and amending Directive 2000/31/EC (Digital Services Act) (hereinafter referred to as the " DSA "), the Seller has designated a contact point for direct communication with the authorities of the EU Member States, the European Commission, the Digital Services Council and Website Users on matters covered by the DSA regulations. The contact point is available at: shop@trzpiotka.com. Communication will be conducted
in Polish. - Information about the Goods available in the Store, in particular their descriptions and prices, constitute an invitation to conclude a Sales Agreement within the meaning of Article 71 of the Act of 23 April 1964, the Civil Code (hereinafter referred to as the " Civil Code ").
- Before using the Store, the Customer is obliged to read the Regulations and the Privacy Policy.
- In matters not regulated in the Regulations, the provisions of the Regulations of the “TRZPIOTKA” online store https://trzpiotka.com/pl/i/Regulamin-Sklepu/3 shall apply.
§2.
Definitions
The words written in capital letters used in the Regulations have the following meaning:
- Gift voucher - a gift voucher issued to the bearer in the form of a card, constituting a sign of legitimacy within the meaning of Article 921(14) of the Civil Code, entitling the User to purchase Goods in the Store for a price not exceeding the agreed value of the Gift Voucher.
- Civil Code - the term defined in § 1, section 7 of the Regulations;
- Consumer - a natural person performing a legal act with the Seller not directly related to his or her business or professional activity;
- Buyer - a person who is a Consumer, an Entrepreneur or an Entrepreneur with Consumer rights, who has concluded an Agreement with the Seller or has taken steps to conclude it;
- Incompatibility – this shall be understood as non-compliance of the Gift Voucher with the Agreement;
- Privacy Policy - a document containing information on the processing of Customers' personal data by the Seller;
- Entrepreneur - a natural person, a legal person or an organizational unit without legal personality, to which special provisions grant legal capacity, conducting business or professional activity on its own behalf;
- Entrepreneur with Consumer Rights - a natural person conducting business or professional activity on his/her own behalf, who has concluded an Agreement with the Seller directly related to his/her business activity, but which is not of a professional nature for that person, resulting in particular from the subject of the business activity performed by him/her;
- Statute - the term defined in § 1 section 1 of the Regulations;
- Seller - the term defined in § 1 section 3 of the Regulations;
- Commodity - a movable item available in the Store within the meaning of the provisions of the Civil Code, which may be purchased by the Buyer, in particular artistic jewelry.
- Agreement – an agreement under which the Seller undertakes to issue a Gift Voucher to the Buyer and the Buyer undertakes to pay the price;
- Consumer Rights Act - Act of 30 May 2014 on consumer rights;
Act on the provision of services by electronic means - the term defined in § 1 section 2 of the Regulations;
§3.
Technical requirements
- In order for Buyers to use the Store properly, it is necessary to:
- connection to the Internet;
- having devices that enable the use of Internet resources;
- using a web browser that enables the display of hypertext documents on the device screen, linked on the Internet via a web service and supporting the JavaScript programming language, and also accepting cookies;
- having an active e-mail account.
- Buyers are prohibited from using viruses, bots, worms or other computer codes, files or programs (in particular scripts and applications automating processes or other codes, files or tools) in the Store.
- The Seller informs that it uses cryptographic protection of electronic transfer and digital content by applying appropriate logical and organizational measures
and technical measures, in particular to prevent third parties from accessing the data, including through SSL encryption, the use of access passwords and anti-virus or anti-unwanted software programs. - The Seller advises that, despite the security measures referred to in paragraph 3 above, the use of the Internet and services provided electronically may be at risk from malicious software entering the Buyer's IT system and device, or from third parties gaining access to data stored on that device. To minimize this risk, the Seller recommends using antivirus software or other online identification protection measures.
§4.
Rules for using the Store
- The Customer is obliged to use the Store in a manner consistent with generally applicable law, the provisions of the Regulations, and good manners.
- The provision of illegal content by the Customer is prohibited.
- The prices of Gift Vouchers available in the Store are expressed in Polish zloty (PLN) and constitute a gross value (they include all mandatory price components, including public law liabilities).
§5.
Purchase a Gift Voucher
1. In order to purchase a Gift Voucher, the Buyer should perform the following steps:
- enter the Store's website;
- select the appropriate Gift Voucher;
- use the "Add to cart" button;
- select the quantity and location from the diagram and use the "Proceed to order" button;
- verify the contents of the basket and then use the "Delivery and payment" button;
- complete the form with the following data:
- e-mail address;
- name and surname or company name (optional),
- Tax Identification Number (optional),
- phone number.
- mailing address;
- select a shipping option;
- choose a payment method;
- check the box next to the declaration of having read the Regulations and the Privacy Policy and accepting their provisions;
- optionally - check the checkbox next to the declaration of consent to receiving the Newsletter;
- use the “Order and pay”/”Pay with BLIK”/”Buy with G Pay” button depending on the chosen payment method.
2. Clicking the "Order and pay" button by the Buyer is equivalent to submitting an offer to purchase the selected Goods (hereinafter referred to as the " Order ").
3. The Seller provides one form of delivery of the Gift Voucher by sending a printed Gift Voucher;
4. The Seller provides payment methods in the form of:
- by bank transfer to the Seller's bank account;

via the Shopify Payments electronic payment system, which enables, among other things, secure payments with payment cards (e.g. Visa, Mastercard, Maestro) and digital wallets (Shop Pay, Apple Pay, Google Pay);

via external operators and fast payments integrated with the store (including BLIK, Przelewy24, PayPo) – currently available payment methods are always presented to the Buyer in the basket during order finalization;
- payment system operated by PayPal,
5. If the Order is not paid within 7 days of its submission, the Seller has the right to cancel the Order within 8 days of the unsuccessful expiry of the payment deadline. Cancellation of the Order will be effected by the Seller sending an appropriate statement to the email address provided by the Buyer.
6. It is prohibited to include any illegal content in the form.
7. The contract is deemed concluded upon receipt of payment in the Seller's bank account.
8. After the payment for the Gift Voucher is credited to the Seller's bank account, the Seller will send the Gift Voucher to the Buyer in the form of a printout to the correspondence address provided by the Buyer within 48 hours.
9. The price for a Gift Voucher cannot be paid using another Gift Voucher.
§6.
Using a Gift Voucher
- The gift voucher is issued to the bearer and does not contain any data allowing the identification of the person authorized to use it.
- The value of an issued Gift Voucher cannot be increased.
- The gift voucher can be used once when purchasing Goods in the Store.
- The Buyer may submit more than 1 (one) Gift Voucher for payment for the purchased Goods.
- A gift voucher is not a payment card and cannot be exchanged for cash.
- The Gift Voucher can be used within a specific period, which is indicated on the Gift Voucher and the description of the Gift Voucher in the Store.
- If the value of the Gift Voucher is lower than the price of the Goods, the conclusion of the Sales Agreement requires the Buyer to pay the remaining price.
- If the value of the Gift Voucher is higher than the price of the Goods, concluding a Sales Agreement will result in the value of the Gift Voucher being reduced by the price of the Goods purchased. The difference between the value of the Gift Voucher and the price of the Goods purchased will not be payable to the Buyer in cash.
- The Seller does not issue duplicates of the Gift Voucher.
- The Seller is not responsible for the use of the Gift Voucher by an unauthorized person who came into possession of it for reasons attributable to the Buyer.
- The Seller is not responsible for any Gift Certificate lost by the Buyer after receipt. Lost Gift Certificates cannot be replaced.
- The Buyer may start using the Gift Voucher immediately after receiving it.
- Using a Gift Voucher in the Online Store involves entering the code assigned to it in the dedicated field of the purchase form.
- Failure to use the Gift Voucher within its validity period does not entitle the Buyer to request a refund of its price from the Seller.
§7.
Right to withdraw from the Contract
- The provisions of this § 7 apply only to the Buyer who is a Consumer or an Entrepreneur with Consumer rights.
- The Buyer has the right to withdraw from the Gift Voucher Purchase Agreement without giving any reason within 14 (fourteen) days from the date of receipt of the Gift Voucher.
- The Buyer exercises the right to withdraw from the Contract by submitting a declaration to the Seller
on withdrawal from the Agreement (hereinafter referred to as the " Declaration "). In order to meet the deadline for withdrawal from the Agreement, it is sufficient to send the declaration before the expiry of the deadline referred to in paragraph 2 above. - The declaration may be submitted by the Buyer in any form, in particular on the form constituting Annex 2 to the Consumer Rights Act.
- When exercising the right to withdraw from the Contract, the Buyer should send the completed form by e-mail to the address indicated in § 1 section 4 point 1 or by traditional mail to the address indicated
in § 1 section 4 point 2 of the Regulations. - The Seller shall send the Buyer confirmation of receipt of the Declaration immediately after its receipt, via e-mail.
- The Gift Voucher price will be refunded within 14 (fourteen) days of the Seller's receipt of the Declaration. The Gift Voucher price will be refunded using the same payment method used by the Buyer in the original transaction, unless the Buyer expressly agrees otherwise. The Buyer will not be responsible for the refund costs.
§8.
Complaints regarding the purchase of a Gift Voucher
- In the event of any irregularities regarding the purchase or use of the Gift Voucher, the Buyer may submit a complaint.
- Complaints may be submitted via e-mail or traditional mail to the addresses indicated in § 1, section 4 of the Regulations.
- The complaint should include:
- name and surname of the Buyer;
- e-mail address or traditional postal address;
- a detailed description of the irregularities observed and (if possible) documents confirming their occurrence;
- request for a complaint.
- If the complaint does not contain the information necessary to consider it, the Seller may ask the person submitting the complaint to supplement it in the indicated scope.
- The Seller shall respond to the complaint within 14 (fourteen) days from the date of its receipt in a correct and complete form.
- Complaints are responded to via e-mail or traditional mail.
§9.
Intellectual Property of the Seller
1. All components of the Store, in particular:
- name of the Store;
- Store logo;
- photos and descriptions;
- the principles of operation of the Store's website, all its graphic elements, interface, software, source code and databases
- are subject to legal protection under the provisions of the Act of 4 February 1994 on Copyright and Related Rights, the Act of 30 June 2000 - Industrial Property Law, the Act of 16 April 1993 on Combating Unfair Competition and other generally applicable provisions of law, including the provisions of European Union law.
2. Any use of the Seller's intellectual property without his prior, express consent is prohibited.
§10.
Processing of personal data
Information on the processing of personal data by the Seller can be found in the Privacy Policy available at: https://trzpiotka.com/pl/i/Polityka-Prywatnosci/11.
§11.
Extrajudicial dispute resolution
1. The provisions of this § 11 apply only to Buyers who are Consumers.
2. The Buyer has the option of using out-of-court complaint and claim settlement methods.
3. Detailed information on the Buyer's ability to use out-of-court complaint and claim settlement methods and the rules for accessing these procedures are available at the registered offices and on the websites of:
- district (municipal) consumer ombudsmen and social organizations whose statutory tasks include consumer protection;
- Provincial Inspectorates of the Trade Inspection;
- Office of Competition and Consumer Protection.
4. The Seller informs that, unless such an obligation results from mandatory provisions of law, it does not use extrajudicial methods of settling complaints and pursuing claims.
§12.
Change of Regulations
- The Seller may make changes to the Regulations in the event of:
- changes to the Seller's data;
- changes in the Seller's scope of business;
- the Seller begins to provide new services, modifies services already provided or discontinues their provision;
- making technical modifications to the Store that require adapting the provisions of the Regulations to them;
- the Seller's decision to introduce more favorable conditions for the use of Gift Vouchers for Buyers.
- legal obligation to make changes, including the obligation to adapt the Regulations to the current legal status.
- Buyers will be informed about changes to the Regulations by publishing the amended version on the Store's website.
- For Agreements concluded before the date of publication of the new Regulations on the Store's website, the provisions of the Regulations in force at that time shall apply.
§13.
Final provisions
- The law applicable to these Terms and Conditions and the Agreements referred to therein is Polish law. However, the choice of Polish law made in the preceding sentence does not deprive the Consumer of the protection afforded by the provisions of foreign law that cannot be derogated from by agreement and that would apply in the absence of the choice of Polish law made in the preceding sentence.
- The current version of the Regulations is effective from July 22, 2025.
